By using this website, requesting an estimate, scheduling service, approving work, making payment, or allowing Apex Gateworks Inc. to perform any inspection, repair, fabrication, installation, maintenance, or related service, you agree to the following Terms & Conditions.

Apex Gateworks Inc. provides custom gate fabrication, automatic gate repair and installation, commercial gates and fences, access control systems, gate operators, custom ironwork, railings, security doors, maintenance, troubleshooting, and related metalwork and automation services.

Estimates and Proposals
All estimates, proposals, quotes, recommendations, and pricing provided by Apex Gateworks Inc. are based on the information available at the time of inspection, customer request, photographs, plans, drawings, or site visit.
Unless otherwise stated in writing, estimates are not final contracts and may be subject to change due to hidden conditions, inaccurate measurements, site access issues, changes in material costs, customer-requested changes, additional labor, permit requirements, unforeseen structural conditions, electrical issues, underground utilities, damaged existing equipment, or other conditions discovered after work begins.
Any work not specifically listed in the written estimate or approved proposal is excluded.

Scope of Work
The scope of work will be limited to the items specifically described in the approved written estimate, invoice, proposal, or contract. Any additional work, modification, repair, upgrade, added material, design change, electrical work, concrete work, welding repair, access control programming, troubleshooting, or return visit outside the approved scope may require a written change order and additional charges.
Verbal conversations, text messages, photos, or general discussions do not modify the scope of work unless confirmed in writing by Apex Gateworks Inc.

Change Orders
Any customer-requested change, added work, unforeseen repair, hidden damage, design modification, code-related requirement, permit requirement, structural issue, material change, or additional labor may result in a change order.
Change orders may affect the total price, material selection, project schedule, warranty, and completion date. Apex Gateworks Inc. is not responsible for delays caused by customer changes, material delays, permit delays, site conditions, third-party vendors, weather, or conditions outside our control.

Existing Conditions
Apex Gateworks Inc. is not responsible for pre-existing conditions, hidden defects, improper prior installation, weak structures, damaged concrete, underground utilities, electrical problems, rotten wood, unstable posts, failing walls, poor framing, old wiring, defective access control systems, misaligned gates, worn hardware, water damage, rust, corrosion, settlement, or any condition not caused by Apex Gateworks Inc.
If existing materials or systems are reused at the customer’s request, Apex Gateworks Inc. does not guarantee their condition, lifespan, appearance, safety, or future performance.

Customer Responsibilities
The customer is responsible for providing safe and reasonable access to the work area, removing vehicles and personal property, securing pets, notifying tenants or occupants, obtaining HOA approval when required, providing accurate property information, and disclosing any known electrical, structural, underground, access, or safety issues.
The customer is responsible for confirming property lines, easements, utility locations, underground lines, gate opening clearances, and any restrictions affecting the work unless Apex Gateworks Inc. is specifically contracted in writing to assist with such items.

Permits, Codes, and Approvals
Unless specifically included in writing, permits, engineering, architectural plans, city approvals, HOA approvals, special inspections, surveys, utility marking, and code upgrades are excluded from pricing.
If permits, engineering, plan revisions, or additional code requirements are required by any city, county, HOA, inspector, property manager, or other authority, the customer is responsible for all related costs, delays, fees, and additional work unless otherwise agreed in writing.
- Automatic Gates and Safety Devices
Automatic gate systems include mechanical, electrical, and safety components that require proper installation, adjustment, testing, and ongoing maintenance. Apex Gateworks Inc. may recommend or require safety devices such as photo eyes, loop detectors, reversing edges, warning signs, proper entrapment protection, access control devices, and other safety-related components.
If a customer declines recommended safety equipment, repairs, upgrades, maintenance, or code-related improvements, the customer accepts full responsibility for any resulting risk, malfunction, injury, property damage, access issue, security issue, or non-compliance.
Apex Gateworks Inc. is not responsible for unsafe operation caused by customer misuse, bypassed safety devices, vandalism, impact damage, lack of maintenance, altered wiring, unauthorized repairs, third-party modifications, power issues, internet issues, phone-line issues, access control provider issues, or defective equipment supplied by others.

Access Control, Intercoms, Keypads, and Smart Systems
Access control systems may depend on electrical power, internet service, cellular service, telephone lines, Wi-Fi, network equipment, cloud services, mobile apps, manufacturer software, third-party subscriptions, customer devices, tenant information, and proper user management.
Apex Gateworks Inc. is not responsible for interruptions, app changes, manufacturer updates, subscription issues, network failures, weak Wi-Fi, cellular problems, phone company issues, internet outages, tenant misuse, incorrect programming information provided by the customer, or discontinued products.
Programming, tenant entry, app setup, user changes, fobs, cards, remotes, codes, access permissions, and reprogramming may be billed separately unless specifically included in writing.

Electrical Work
Unless specifically included in writing, Apex Gateworks Inc. does not include new electrical service, trenching, conduit runs, panel work, breaker installation, dedicated circuits, low-voltage wiring outside the described scope, internet wiring, network setup, or troubleshooting of existing electrical systems.
The customer is responsible for providing proper power at the required location unless otherwise stated in the approved proposal.

Materials, Fabrication, and Finishes
Custom metal fabrication may include natural variations in welds, grinding, texture, alignment, surface preparation, steel shape, finish, primer, paint, powder coating, galvanizing, and final appearance. Minor variations are normal and do not constitute defective work.
Steel products may rust over time if exposed to weather, moisture, sprinklers, irrigation, coastal air, scratches, impact, lack of maintenance, or damage to protective coatings. Maintenance, repainting, touch-up, lubrication, and corrosion prevention are the customer’s responsibility after completion unless a maintenance plan is purchased.

Measurements and Design
Dimensions, drawings, renderings, photos, website images, and design examples are for general reference unless specifically stated as final approved shop drawings. Final field measurements may vary based on site conditions, walls, slopes, concrete, framing, clearance, and existing structures.
Customer approval of design, measurements, materials, colors, finish, layout, hardware, and access control equipment may be required before fabrication or installation.

Payments
Payment terms will be listed in the approved estimate, invoice, proposal, or contract. Deposits, progress payments, and final payments are due as stated.
Apex Gateworks Inc. may pause scheduling, fabrication, ordering, delivery, installation, warranty service, or project completion if required payments are not received on time.
Final payment is due upon substantial completion unless otherwise stated in writing. Substantial completion means the contracted work is complete enough for its intended use, even if minor touch-ups, adjustments, or manufacturer parts remain pending.
Late payments may be subject to collection costs, administrative fees, legal fees, lien rights, and any other remedies allowed by law.

Cancellations and Deposits
Deposits may be used for material purchases, custom fabrication, scheduling, labor allocation, design time, administrative work, and project preparation.
Because many Apex Gateworks Inc. projects involve custom materials and fabrication, deposits may be non-refundable once materials are ordered, fabrication begins, special-order equipment is purchased, or labor has been scheduled.
Cancellation requests must be submitted in writing.

Scheduling and Delays
Project dates, service windows, start dates, and completion dates are estimates only unless specifically guaranteed in writing. Apex Gateworks Inc. is not responsible for delays caused by weather, traffic, supplier delays, manufacturer backorders, permit issues, customer delays, site access problems, unsafe work areas, power issues, third-party contractors, inspections, change orders, or unforeseen conditions.

Warranty
Apex Gateworks Inc. stands behind its workmanship as stated in the written estimate, invoice, proposal, or contract. Warranty coverage applies only to work performed and materials supplied by Apex Gateworks Inc.
Warranty does not cover misuse, abuse, impact damage, vandalism, accidents, lack of maintenance, rust caused by environmental exposure, normal wear and tear, customer modifications, third-party repairs, power surges, electrical issues, internet or phone service issues, water damage, fire, theft, acts of nature, settlement, structural movement, or failure of existing equipment or materials not supplied by Apex Gateworks Inc.
Manufacturer equipment warranties are limited to the manufacturer’s terms. Labor to remove, diagnose, reinstall, reprogram, or replace manufacturer-warranty parts may be billed separately unless otherwise stated in writing.

Maintenance
Gates, operators, hinges, wheels, tracks, chains, belts, arms, sensors, access control systems, safety devices, locks, and related equipment require regular maintenance. Failure to maintain the system may result in noise, malfunction, premature wear, safety issues, access problems, or damage.
Apex Gateworks Inc. recommends scheduled preventive maintenance for automatic gates and commercial systems. Maintenance plans are separate from warranties unless specifically stated in writing.

Emergency Service
Emergency service, same-day service, after-hours service, weekend service, temporary repairs, lockout response, and urgent troubleshooting may be subject to additional charges. Apex Gateworks Inc. does not guarantee immediate response unless confirmed in writing.
Temporary repairs are not permanent solutions and may require further work, replacement parts, or upgrades.

Customer-Supplied Materials
If the customer supplies equipment, hardware, locks, operators, access control devices, electronics, paint, materials, or parts, Apex Gateworks Inc. is not responsible for defects, missing parts, compatibility issues, delays, failure, warranty, or performance of those items.
Labor to install, modify, troubleshoot, remove, or replace customer-supplied materials may be billed separately.

Photos, Videos, and Project Documentation
Apex Gateworks Inc. may take photos or videos of work areas, existing conditions, progress, completed work, equipment, gate systems, access control systems, and safety concerns for documentation, communication, estimates, warranty records, and business purposes.
Apex Gateworks Inc. may use photos or videos of completed work for marketing, website, social media, portfolio, training, or advertising purposes, unless the customer requests in writing that the property not be shown. Apex Gateworks Inc. will make reasonable efforts not to display private personal information, license plates, addresses, faces, or sensitive security details.

Limitation of Liability
To the maximum extent permitted by law, Apex Gateworks Inc. is not liable for indirect, incidental, special, consequential, punitive, or loss-of-use damages, including loss of business, loss of access, loss of rent, security incidents, tenant complaints, gate downtime, delay damages, lost profits, or inconvenience.
Apex Gateworks Inc.’s total liability for any claim related to services, materials, website use, or project work shall not exceed the amount paid by the customer for the specific work giving rise to the claim, unless otherwise required by law.

No Guarantee Against Crime or Unauthorized Access
Gates, fences, access control systems, locks, cameras, intercoms, and security products are deterrents and access management tools. They do not guarantee prevention of theft, vandalism, trespassing, break-ins, injury, property damage, or unauthorized access.
Apex Gateworks Inc. is not an insurer of the property or occupants. The customer is responsible for maintaining insurance and proper security procedures.

Disputes
If a dispute arises, the customer agrees to first notify Apex Gateworks Inc. in writing and provide a reasonable opportunity to inspect, correct, repair, or resolve the issue before hiring another contractor, withholding payment, filing a claim, posting negative reviews, or pursuing legal action.
Any dispute shall be handled according to applicable California law.

Collection, Liens, and Legal Fees
If payment is not made when due, Apex Gateworks Inc. reserves all rights available under California law, including collection, mechanic’s lien rights, stop notices, recovery of administrative costs, attorney’s fees, court costs, and other remedies allowed by law.

Privacy
Information submitted through the website, phone, email, text message, forms, or service requests may be used to respond to inquiries, schedule appointments, prepare estimates, perform work, process payments, and communicate with the customer.
Apex Gateworks Inc. does not sell customer information. However, information may be shared when necessary with employees, subcontractors, suppliers, manufacturers, payment processors, insurance providers, legal representatives, or authorities as needed to perform services, process claims, comply with law, or protect company rights.

Acceptance of Terms
By using this website, requesting an estimate, approving a proposal, scheduling work, making payment, or allowing Apex Gateworks Inc. to begin work, the customer acknowledges that they have read, understood, and agreed to these Terms & Conditions.
